The hospital industry, through CMS, is now providing even more statistical data on quality measures for consumers much like other competitive industries. Consumers will now be "better equiped" to choose between healthcare providers based on the data reported to CMS, according to a CMS News Release on July 7, 2010. HHS Press Conference, July 13: Final Rules to Support Meaningful Use of EHR

CMS posted a recording of a Press Conference on July 13, 2010, where Health and Human Services Secretary Kathleen Sebelius announced final rules to help improve Americans' health, increase safety and reduce health care costs through expanded use of electronic health records (EHR).
Present at the Press Conference were:
- Kathleen Sebelius, Secretary, US Dept of Health & Human Services (HHS)
- Dr. Donald Berwick, Director, Center for Medicare & Medicare Services (CMS)
- Dr. David Blumenthal, Director, ONC for Health IT
- Dr Regina Benjamin, US Surgeon General
- Reginal Holliday, patient advocate.

Recess Appointment Must Still Be Approved by Congress
The White House appointed Dr. Donald Berwick of Harvard Medical School as the new Administrator of the Centers for Medicare and Medicaid Services, Department of Health and Human Services (CMS) on July 7, using a recess appointment, a process that allows the President to make an appointment to a federal office without the normal Senate approval.

Lack of Clear Orders Puts Facility at Risk
Inpatient admissions in 17 states can now be audited by Connolly Healthcare, the CMS Recovery Audit Contractor (RAC) for Region C, such as in cases where a short length of stay for certain conditions or treatments (e.g., Chest Pain, Pacemaker) might reasonably be handled in a less intensive site of service, such as outpatient or observation.The lack of a clear written order in the medical record defining the physician's intent for meeting the patient's needs clearly places the facility at risk of recoupment.

Three of the four CMS Recovery Audit Contractors (RACs) posted new issues in the first two weeks of June, including 39 DRG Validations issues. The Region A RAC, DCS, has also posted an approved issue to review Evaluation & Management (E&M) codes for New Patient visits, mirroring the same issues already approved for other RACs. Despite recent reports that issues including review of Medical Necessity have already been approved by CMS in at least one region, none of the RACs have yet to post any such approved issues.
